Terms of Service — PekBUS

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the PekBUS mobile application (“App”) and related services operated by Peklenc Research Private Limited (“we”, “us”, or “our”), a company registered in India.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

If you are using PekBUS on behalf of an organisation (such as a school, employer, or fleet operator), you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

PekBUS is a bus and fleet tracking platform. It allows transport providers — such as schools, employers, contractors, and fleet operators (each, a “Transport Provider”) — to share live vehicle location, trip progress, and estimated arrival times with their authorised users.

PekBUS operates in a B2B2C model. The service is typically provided through a Transport Provider that has a separate agreement with us. End users (parents, guardians, employees, riders, drivers) access PekBUS because their Transport Provider has deployed it to them.

3. Eligibility

PekBUS is intended for users aged 18 and above. By using the App, you represent that you are at least 18 years of age.

If a Transport Provider deploys PekBUS for use involving minors (for example, where a student is an authorised viewer of their own school bus), the Transport Provider is responsible for ensuring appropriate parental or guardian consent is obtained as required by applicable law.

4. User Accounts and Access

PekBUS uses device-based registration. You may be onboarded through a QR code, invite code, or organisation identifier provided by your Transport Provider.

You are responsible for:

• Maintaining the security of the device used to access PekBUS
• Ensuring that only authorised individuals use your registered device
• Promptly notifying your Transport Provider if you believe your access has been compromised

We reserve the right to suspend or revoke access to any device or account at any time, including at the request of a Transport Provider, or if we reasonably believe the Terms are being violated.

5. Acceptable Use

You agree not to:

• Use PekBUS for any unlawful purpose
• Attempt to interfere with, disrupt, or compromise the App, its servers, or its infrastructure
• Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the App
• Use automated tools, bots, or scrapers to access or collect data from the App
• Impersonate another user, device, or organisation
• Share, redistribute, or sublicense the App or any part of the service without our written consent
• Use the GPS tracking functionality to track or surveil any person without proper authorisation from the relevant Transport Provider

6. Location Data and Permissions

PekBUS collects precise location data from driver devices during active trips to enable live bus tracking and ETA calculation. Background location may be collected when the trip is active and the relevant device permission has been granted.

Location data is collected only during active trips and stops when the trip ends. Details of our data collection practices are described in our Privacy Policy.

You may revoke location permissions through your device settings at any time, though this may prevent certain features from functioning.

7. Intellectual Property

The App, its design, code, features, branding, logos, and all related content are owned by Peklenc Research Private Limited and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App solely for its intended purpose in connection with an authorised Transport Provider deployment.

This licence does not grant you any rights to use our trademarks, trade names, or branding without our prior written consent.

8. Third-Party Services

PekBUS integrates third-party services including mapping providers, push notification services, crash reporting tools, and cloud infrastructure. These services are subject to their own terms and privacy policies.

We are not responsible for the availability, accuracy, or practices of third-party services, except to the extent required by applicable law.

9. Availability and Service Levels

We aim to keep PekBUS available and reliable, but we do not guarantee uninterrupted or error-free operation.

We may temporarily suspend or modify the service for maintenance, updates, security patches, or other operational reasons. Where reasonably possible, we will provide advance notice of planned disruptions.

ETA calculations and live tracking are estimates based on GPS data and route geometry. Actual arrival times may vary due to traffic, weather, route changes, device connectivity, or other factors. PekBUS is an informational tool and should not be relied upon as the sole basis for safety-critical decisions.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• PekBUS is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
• Our total liability for any claim arising from or related to the App shall not exceed the amount you have paid us directly (if any) in the twelve months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Peklenc Research Private Limited, its officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your misuse of the App or violation of these Terms.

12. Termination

You may stop using PekBUS at any time. You may also request deletion of your data through Settings > Delete My Data within the App, or by contacting us at support@pekbus.com.

We may terminate or suspend your access at any time, with or without notice, if we believe you have violated these Terms, if your Transport Provider requests it, or if we discontinue the service.

Upon termination, your licence to use the App immediately ceases. Provisions that by their nature should survive termination (including Intellectual Property, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

13. Modifications to Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date and, where appropriate, notify you through the App or another reasonable channel.

Your continued use of PekBUS after any changes constitutes acceptance of the revised Terms. If you disagree with any changes, you should stop using the App.

14. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Gautam Budh Nagar, Uttar Pradesh, India.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Peklenc Research Private Limited regarding your use of PekBUS as an end user, and supersede any prior agreements or understandings on this subject.

Separate agreements may exist between Peklenc Research Private Limited and your Transport Provider governing the commercial and operational terms of the service.
